Court Backs Teva on Generic Herpes Treatment

A U.S. appeals court ruled in favor of Teva Pharmaceutical Industries Ltd. in its attempt to sell a generic version of a Novartis AG herpes drug before the drug's patents expire. A panel of the U.S. Court of Appeals for the Federal Circuit in Washington reversed a lower-court decision that was in favor of Novartis. Teva, of Israel, wants to sell famciclovir, the active ingredient of Novartis's Famvir. The drug's compound patent expires in 2010.
