QLT To Pay for Eligard Patent Infringement

QLT USA, Inc. (formerly Atrix Laboratories, Inc.) has reached an agreement to settle a patent infringement suit filed by Tap Pharmaceuticals.

Under terms of the agreement, QLT  will pay $112.5 million to Tap, Takeda Chemical Industries, Ltd. and Wako Pure Chemical Industries Ltd. The lawsuit claimed that the unit's Eligard products infringed on the plaintiffs' patents.

Also named in the lawsuit was Sanofi-Synthelabo, which will pay $45 million to the plaintiffs in the settlement.

Neither QLT nor Sanofi-Synthelabo acknowledged any wrongdoing.

The settlement also allows QLT a non-exclusive, perpetual royalty-free license to use and sell any of the company's past and future patents to make Eligard products in the U.S. and Canada.
