Novo Nordisk Wins Diabetes Lawsuit

Danish drug developer Novo Nordisk AS said Tuesday it successfully defended a false-advertising lawsuit brought by French rival Sanofi-Aventis over diabetes treatment.

The lawsuit, filed in U.S. District Court in New Jersey, alleged that Novo Nordisk falsely advertised claims about its insulin injection Levemir in both pre-launch and launch materials.

Sanofi-Aventis, which sought a preliminary injunction, had previously dropped its claims on the launch materials, Novo Nordisk said.

Ruling on the remaining claims over the pre-launch materials, the company said the court ruled there was no "reasonable probability of success on the merits" of Sanofi's complaint.

Sanofi-Aventis competes with Novo Nordisk in the diabetes treatment market with its Lantus insulin injection. Novo Nordisk claimed in the advertising that Levemir worked up to 24 hours. Sanofi had disputed that and several other claims.

Sanofi-Aventis could not immediately be reached for comment.
