Third Wave To Resolve Hep C Patent Disputes

Third Wave Technologies Inc. said Thursday it agreed to resolve with various companies all but one of its remaining patent disputes.

The Madison-based biotechnology company said it plans to settle lawsuits it filed in October against Chiron Corp. of Emeryville, Calif., and Bayer AG of Germany and Bayer's healthcare unit over patents for Third Wave's hepatitis C virus.

No licenses were granted or taken under the agreement and no payment was made to any of the companies, Third Wave said.

Terms were not disclosed.

Third Wave resolved a lawsuit with Innogenetics NV of Belgium earlier this month and reached an "amicable agreement" with Digene Corp., of Gaithersburg, Md., in January.

Third Wave said its last remaining patent dispute concerns Stratagene Corp., a La Jolla, Calif., maker of life science research and diagnostic products.
